SPECIFIC POWERS OF SEIZURE UNDER THE PREVENTION OF TERRORISM (ADDITIONAL POWERS) ACT 1996

The police are provided with the power to seize and retain items (except those subject to legal privilege) in non-residential premises and from persons on such premises, which are found in the course of a search under s2 of the 1996 Act (see Chapter 3). This may be done if any item is reasonably believed to be of substantial value to a terrorist investigation and that it is necessary to prevent it from being concealed, lost, damaged, altered or destroyed.

Under Schedule 6A to the 1996 Act, which is linked with s4, the police may seize and retain anything found on premises or on any person found there which are within a police cordon and are subject to a search under written authority by a superintendent or above (see also Chapter 3). Any property seized must not be subject to legal privilege and it must be reasonably believed that it is likely to be of substantial value to a terrorist investigation and seizure is necessary to prevent its concealment, loss, damage, alteration or destruction.
